Earthkwak Games' Terms of Service

These Terms of Service ("Terms") govern your download, installation, and use of video games developed and published by Earthkwak Games ("we", "us", or "our") across the Google Play Store, Apple App Store, and Nintendo Switch™ eShop.

By downloading or playing our games (such as Super Bear Adventure), you agree to be bound by these Terms.

1. End User License Grant

Subject to these Terms, Earthkwak Games grants you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and play our games on supported devices. Your use of the game software is subject to the Content Creation guidelines in Section 3 below.

2. Platform Terms

Your download and use of our games must also comply with the terms of the platform from which you acquired the game:

• Google Play Store: Subject to the Google Play Terms of Service.
• Apple App Store: Subject to the Apple Licensed Application End User License Agreement (EULA).
• Nintendo Switch™ eShop: Subject to the Nintendo Account Agreement and Nintendo Switch EULA.

3. Content Creation & Streaming Policy

We love seeing our players share their experiences! You are welcome and encouraged to create, upload, and stream video content featuring our games (such as let’s plays, walkthroughs, reviews, and live streams) on video and streaming platforms.

• Monetization allowed: You may monetize your videos through standard platform ad revenue, partner programs, and subscriber donations.
• No raw re-uploads: You may not simply re-upload official trailers, teasers, game soundtracks, or promotional materials in their original, unedited form without our prior written approval. Your content must involve your own original commentary, edits, or gameplay.
• Other restrictions: You may not sell game files, place game content behind a paid paywall (charging viewers to access videos), or imply that your content is officially endorsed or sponsored by Earthkwak Games unless.

4. Intellectual Property

All rights, titles, and interests in and to our games (including artwork, characters, audio, code, logos, and trademarks such as Super Bear Adventure) are the exclusive property of Earthkwak Games. You may not copy, reverse engineer, decompile, distribute, or create derivative works based on our games without prior written consent.

5. In-Game Purchases & Virtual Items

If a game offers virtual items, currency, or ad-removal purchases:

• Purchases are processed entirely through the relevant store (Google Play Store for Android, Apple App Store for iOS).

• Purchases are not transferable between accounts or platforms.

• All purchases are processed through your device's platform store and are subject to their respective refund policies. However, Earthkwak Games may, at its sole discretion, approve refund requests on a case-by-case basis for accidental purchases.

6. Support & Customer Service Response Time

We strive to provide assistance with bug reports and support inquiries.

7. Disclaimer of Warranties

Our games are provided on an "As is" and "As avaible" basis without warranties of any kind, express or implied. Earthkwak Games does not guarantee that game operation will be uninterrupted, error-free, or compatible with every device configuration.

8. Limitation of Liability

To the maximum extent permitted by law, Earthkwak Games shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use or inability to use our games.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.
